Press Release - Families of Sharm el-Sheikh crash victims
to sue Boeing in the United States
December 13, 2004 -- Families of victims
of the Boeing plane crash in which 148 people died in the Egyptian
Red Sea resort of Sharm el-Sheikh in January have taken legal
action in the United States against Boeing and two other US
aeronautics firms, their lawyers said Monday.
The crash of the chartered Flash Airlines
Boeing 737, which claimed the lives of 135 French nationals
soon after take-off on January 3, 2004, was the worst air disaster
ever to hit France in terms of the number of French nationals
killed.
The lawyers for the plaintiffs said the
lawsuit would target Boeing, electronics and aerospace group
Honeywell and premier aircraft lessor International Finance
Lease Corporation (ILFC), which owned and was leasing the Boeing
737-300 to the Egyptian charter company Flash Airlines when
it crashed.
Some 20 French and US lawyers have been
jointly defending 124 of the 148 victims' families which have
formed an association led by Frenchman Marc Chenet.
Monday, a San Francisco legal firm brought
the case before a federal court in Los Angeles seeking damages
and a trial, citing plane dysfunction, negligence and other
irregularities.
"One minute after take-off, the
plane began to veer to the right, which was not in line with
any instruction from the pilot," US lawyer Robert Nelson
told a press conference in Paris.
"The richer the company being sued
is, the higher the amount of punitive damages can be," said
another US lawyer, Robert Lieff, who noted that ILFC owns a
third of the world's civilian airliner fleet.
In France, the association's legal team
is suing Flash Airlines and a hearing is set for Janaury 18.
The lawyers said they have filed a total
of 1,200 legal actions to demand a total of more than 200 million
euros for moral prejudice alone.
