Global Aviation News Article
September 2, 2006
Louisville Courier-Journal, "Comair Accident: Suits
filed in Comair crash"
As
the first lawsuits were filed yesterday by families of Comair Flight 5191 victims,
aviation law experts said plaintiffs can expect to recover several million dollars
each, depending on earnings and life expectancies of those who died.
The first
two lawsuits were filed in federal and state courts in Lexington, claiming Comair
was negligent when its crew took off on the wrong runway Sunday, crashing and
killing 49 of the 50 people aboard.
The suits say the
pilots -- including the lone survivor, First Officer James Polehinke -- were
negligent in choosing a runway that was too short and in failing to follow procedures
that would have averted the mistake.
